MAYKALAPEXFIT provides digital fitness coaching, health optimization guidance, and related digital products through subscription-based tiers (Apex Forge, Apex Alpha, Apex Predator). Services include but are not limited to: personalized training guidance, nutrition protocols, hormonal optimization education, AI-powered coaching assistance, community access, daily check-ins, progress tracking, and habit monitoring tools.

3. Subscription & Payment

All subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring monthly charges to your payment method. Prices are as follows:

• Apex Forge: €27/month
• Apex Alpha: €77/month
• Apex Predator: €197/month

All prices are final (no VAT under Kleinunternehmerregelung §19 UStG). Subscriptions renew automatically unless cancelled before the next billing cycle.

4. Cancellation & Refunds

You may cancel your subscription at any time through your account settings or by contacting us directly. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle. As digital services begin immediately upon subscription, the 14-day EU withdrawal right (Widerrufsrecht) may be waived upon your explicit consent at the time of purchase, in accordance with §356 Abs. 5 BGB.

MAYKALAPEXFIT provides educational fitness and health optimization content. Our services are NOT medical advice. We are not licensed medical professionals. All training, nutrition, and supplementation recommendations are for educational purposes only. You should consult a qualified healthcare provider before starting any new exercise program, diet, or supplementation protocol. By using our services, you acknowledge that you participate at your own risk and that MAYKALAPEXFIT is not liable for any injuries, health complications, or adverse effects resulting from following our guidance.

6. User Conduct

Users agree to use the platform respectfully and lawfully. Prohibited conduct includes: sharing login credentials, redistributing paid content, harassing other community members, posting illegal or harmful content, attempting to reverse-engineer or exploit the platform, and any behavior that disrupts the community experience. MAYKALAPEXFIT reserves the right to terminate accounts that violate these terms without refund.

7. Intellectual Property

All content provided through MAYKALAPEXFIT — including training programs, nutrition protocols, educational materials, AI-generated responses, and community content created by MAYKALAPEXFIT staff — is the intellectual property of MAYKALAPEXFIT. Users may not reproduce, distribute, or commercially exploit this content without explicit written permission.

8. Data Protection (GDPR)

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Bundesdatenschutzgesetz (BDSG). Data collected includes: name, email, fitness data (check-ins, workouts, progress photos, habits), and payment information (processed by Stripe). For full details, see our Privacy Policy.

9. Limitation of Liability

MAYKALAPEXFIT's liability is limited to the amount paid by the user in the 3 months preceding any claim. We are not liable for indirect, incidental, or consequential damages. This limitation does not apply to damages caused by intentional misconduct or gross negligence, or where liability cannot be excluded under German law.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Solingen, Germany, to the extent permitted by law. For EU consumers, mandatory consumer protection provisions of the consumer's country of residence remain applicable.

11. Changes to Terms

MAYKALAPEXFIT reserves the right to modify these Terms at any time. Users will be notified of material changes via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.
